The basis and backbone of worldwide trade is logistics. Smooth delivery to the customer and the functioning of the supply of the own warehouses or own production with goods are essential for every company.

Globalization has made transport processes even more complex. More and more service providers of different nationalities from different cultures with different languages are involved in transport chains and more handling operations are required. The increased risks for the goods resulting therefrom cannot be ruled out despite technical progress.

The transportation law governing these processes is multi-layered, fragmented, confusing, international, and complex. Each mode of transport is internationally regulated in separate treaties under international law such as CMR, MC, WC, CIM or CMNI. In the absence of such rules and if the parties have not agreed on anything, the applicable law must be determined with the help of conflict-of-law provisions, which is sometimes difficult and leads to surprising results for the companies involved.
